Terms and Conditions
1. Scope
These General Terms and Conditions apply to all deliveries and services provided by Bärtschi Kälte GmbH, unless otherwise agreed in writing.
2. Conclusion of the Contract
The contract is concluded upon written confirmation of the order by Bärtschi Kälte GmbH. Offers are subject to change.
3. Prices and Payment
The prices listed are net prices, plus applicable value-added tax. Unless otherwise agreed, payments are due without any deductions within 14 days of the invoice date.
4. Delivery
Delivery times are non-binding unless expressly agreed upon as binding. Partial deliveries are permitted. Risk passes to the buyer upon delivery of the goods.
5. Retention of Title
The delivered goods remain the property of Bärtschi Kälte GmbH until full payment has been made.
6. Warranty
The warranty is governed by statutory provisions. The buyer is required to inspect the goods for defects immediately upon receipt and to notify us in writing of any defects within 7 days.
7. Liability
Bärtschi Kälte GmbH's liability is limited to cases of willful misconduct and gross negligence. In cases of slight negligence, Bärtschi Kälte GmbH is liable only for damages resulting from injury to life, body, or health.
8. Final Provisions
Any amendments to these Terms and Conditions must be made in writing. Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
